The government's position, articulated by prosecutor Clay Trivett, is that this case is not about torture. "We're trying these five men for the summary execution of 2,976 people," Trivett said. He added that the defense's problem is not with the protective order but, rather, with the "original classification authority." While the torture may become relevant at some point in the military commission, "the defense has all of the tools necessary to present whatever those issues are to the court," he countered. Additionally, Trivett argued that the Convention Against Torture is not self-executing and requires additional legislation to have full legal effect in the United States.
