While there is an international recognition of a nation and an individual’s right to self-defense through armed conflict, these rights are controlled and limited by international treaties and customs of international law.[xvi] Although there had always been some kind of informal limits on the conduct of warring parties in regards to civilians on the battlefield, the 20th century produced formal treaties and agreements that sought to protect civilians that were not participants in the conflict.[xvii] The Hague Regulations of 1907 seemed to protect civilians caught in the cross fire only incidentally by limiting the use of poison and restricting bombardment of cities that were left undefended by military forces.[xviii] After the destruction wrought by World War II, the Geneva Conventions of 1949 sought to further regulate the conduct of war, but also gave more extensive righ...
